Twotoneatl Photography Usage Agreement
My images are ROYALTY FREE, EXCEPT for the following applications:
Print/Display Applications
- WHEN USED ON PRODUCTS FOR SALE;
- LOGO DESIGN;
- RETAIL PACKAGING/POINT OF SALE DISPLAY/USE IN OR ON SIGNAGE, DISPLAYS OR DEVICES OR GAMES OF ANY NATURE WHETHER EMBEDDED IN SUCH DEVICES OR GAMES AS SOFTWARE OR MERELY DISPLAYED.
Twotoneatl grants a nonexclusive, nontransferable right to use Twotoneatl Royalty Free Images for the following purposes:
Images MAY BE USED on a worldwide and perpetual basis with proper Editorial Credit for:
Advertising, promotion, communication, and editorial use in the following mediums: newspapers, direct mail, consumer magazines, trade magazines, television commercials, annual reports, billboards, point-of-sale displays, brochures, newsletters, invitations, internet banners, website graphics, impermanent signs, transit boards, sales kits, trade show display, and any promotional items that are given away free of charge.
Images MAY NOT BE USED for the following purposes:
Product for sale, packaging, electronic books, game playing or gaming devices, as a logo or trademark, sublicensed as part of or together with your work, defamatory, prurient or libelous purposes (see below).
Twotoneatl Images may not be used on product for sale such as t-shirts, mugs, cards, CD packaging, general packaging, hang-tags, books, and other products that are sold (editorial use by newspapers and magazines is permitted) or in or with games, game playing devices or in gaming or gambling devices. Further, these images may not be used in any type of corporate or trademark style guide and may not be used as reference, a comp (comprehensive) or prototype for design or images that may be incorporated into a product that is sold.
If you would like to use an image for any of these purposes, you must contact me to arrange a license agreement.
Twotoneatl Images may not be redistributed, syndicated, resold, sublicensed, or placed online in an FTP or other downloadable format.
All images are the exclusive property of TWOTONEATL. All Rights Reserved.
This agreement shall be governed by and construed in accordance with the laws of the state of Georgia, without regard to conflict of laws or provisions or the conflict of law provisions of any other jurisdiction. You hereby agree to the personal jurisdiction of any court selected by Twotoneatl in any action or proceeding arising out of or related to this agreement. You further agree to waive any jurisdictional or venue defenses and to service of process by mail.Editorial Credits: Images used for editorial purpose must be accompanied by the following credit “Image(s): Jon Woodroof – twotoneatl.com” or “Photo by Jon Woodroof | twotoneatl.com.”
